Como garantir o correto enquadramento fiscal para a empresa?

Garantir a solvência de uma empresa é um dos principais desafios dos empreendimentos. Para manter um negócio lucrativo, entre os diversos fatores que precisam ser analisados e planejados a fim de evitar problemas futuros, o enquadramento fiscal é um deles.

De modo geral, o enquadramento fiscal é a forma como o governo padroniza a obrigatoriedade do recolhimento dos impostos e do envio das obrigações acessórias por parte das empresas. Neste post, trataremos sobre o que é enquadramento fiscal e sobre as suas principais características. Leia e confira!

O que é enquadramento fiscal?

Os regimes fiscais são um conjunto de normas e obrigações com as quais as organizações precisam estar em dia, caracterizando-se pela obrigação principal, que é o recolhimento dos tributos, e pelas obrigações acessórias, que são as declarações pertinentes a cada regime tributário. Uma vez que essas regras não são cumpridas, a empresa fica passível de multa e de autuações, consequentemente, tendo o seu caixa afetado.

Para compreender qual o melhor enquadramento fiscal para a empresa, é necessário entender que elas são separadas por modalidades:

  • Microempreendedor Individual;
  • Sociedade Limitada;
  • Sociedade Anônima;
  • Microempresa;
  • Empresa de Pequeno Porte.

Após isso, é fundamental verificar quais serão as atividades prestadas. Essas são classificadas conforme a Classificação Nacional de Atividades Econômicas (CNAE).

A partir dessas atividades, é verificado qual enquadramento fiscal traz melhores benefícios para a empresa, é claro, mantendo a legalidade das informações. Vale lembrar que cada regime fiscal tem as suas particularidades e são esses fatores que permitirão ou não que a empresa possa optar por tal enquadramento.

Quais são os principais regimes fiscais no Brasil?

No Brasil, os regimes tributários mais utilizados são: Simples Nacional, Lucro Real e Lucro Presumido. Conheça um pouco mais sobre eles.

Simples Nacional

Como o próprio nome diz, esse modelo tributário foi criado para simplificar o recolhimento dos impostos para as empresas. O imposto é recolhido pelo Documento de Arrecadação do Simples Nacional (DAS). Nele, estarão englobados os tributos das três esferas governamentais — federal, estadual e municipal.

Além dessa particularidade, apenas as Microempresas, as Empresas de Pequeno Porte e o Microempreendedor Individual são aptos ao Simples Nacional. Ainda é necessário, no entanto, analisar o faturamento, que, nesse regime, vai de R$ 81 mil a R$ 4,8 milhões por ano.

Ficam impossibilitadas de optarem pelo Simples as empresas que exercerem atividades não permitidas nesse regime. Visto isso, a análise da CNAE é imprescindível nessa etapa.

Lucro Real

Em um primeiro momento, esse enquadramento parece ser o mais difícil dos regimes fiscais, pois tem alíquotas mais elevadas e um número maior de declarações a serem entregues. Outro ponto de destaque é que a contabilidade tem papel importante na apuração dos impostos desse enquadramento fiscal.

Isso porque, no Lucro Real, é possível se aproveitar do prejuízo contábil no momento do cálculo do Imposto de Renda e da Contribuição Social sobre o Lucro Líquido. Logo, estar em dia com a escrituração contábil é fundamental para se aproveitar disso.

Via de regra, as empresas que tiverem um faturamento acima de R$ 48 milhões estão diretamente obrigadas ao Lucro Real. Além disso, o mesmo vale para algumas atividades, como:

  • bancos;
  • cooperativas;
  • factoring.

As empresas que não são obrigadas ao Lucro Real, mas que, após uma análise prévia, identificarem benefícios fiscais, podem optar por esse regime de forma espontânea.

Lucro Presumido

Esse regime tributário tem regras equiparadas ao Lucro Real, no entanto, ele não permite as deduções que o Lucro Real dispõe. Como o próprio nome remete, esse enquadramento tem alíquotas estabelecidas. Dessa forma, independentemente do resultado contábil, para a apuração dos tributos, será utilizado como base de cálculo o faturamento.

Diferentemente do Simples Nacional, no Lucro Presumido, os impostos são arrecadados de forma individual por meio do Documento de Arrecadação de Receita Federal. As empresas não obrigadas ao Lucro Real e com faturamento inferior a R$ 78 milhões podem recolher os seus impostos por esse enquadramento.

Como podemos ver, todos os regimes fiscais têm as suas diferenciações. Dessa forma, cabe aos gestores, com o auxílio de um profissional contador, pesquisar e organizar um planejamento tributário que reduza a onerosidade dos impostos e que mantenha a empresa dentro da legalidade.
